Vuno announces Supreme Court appeal plan over patent invalidation ruling

Medical artificial intelligence company Vuno said on the 19th that it plans to appeal to the Supreme Court against a second-instance ruling in patent invalidation proceedings initiated by Company A.

Medical artificial intelligence (AI) company Vuno said on the 19th that it plans to challenge a second-instance ruling in patent invalidation proceedings initiated by Company A by appealing to the Supreme Court.

On the 30th of last month, the Patent Court revoked the Intellectual Property Trial and Appeal Board’s decision finding Vuno’s patent valid in litigation seeking to overturn that decision. The ruling differed from the board’s February 2025 decision rejecting all requests to invalidate the patent.

The dispute began in 2023 when Vuno sued Company A, alleging that its AI solution for predicting patient deterioration infringed patents related to Vuno’s VunoMed DeepCARS product. Company A requested invalidation trials for two Vuno patents in May of the following year, and the latest ruling concerns those invalidation proceedings.

Patent invalidation proceedings determine whether a patent itself is valid, while patent infringement litigation determines whether another company’s product infringes it. In the separate infringement case, a first-instance ruling in July found in substance that infringement was not established; Vuno appealed, and the appeal is pending before the Patent Court.

A Vuno representative said the company would appeal to the Supreme Court and defend its patent rights until a final ruling, given the differing conclusions of the tribunal and the Patent Court.

The company said it would protect VunoMed DeepCARS through multiple patents even if the Supreme Court upheld the invalidity finding. It also argued that sales would be unaffected because the Patent Court ruling does not become final before the appeal period expires.
